How Savvy Are You About New York State Regulations on Fireworks and Sparkling Devices?

Does New York allow fireworks?

New York State does not allow the sale or distribution of fireworks. The items you see here in New York, are called “Sparkling Devices”. These are ground-based or hand-held devices that produce sparks, colored flame, noise, and or smoke. They do not rise into the air, do not fire inserts or projectiles into the air, and do not explode. They are limited in size by the weight of the pyrotechnic chemicals.

When can I use Sparkling Devices?

The New York State Department of Environmental Conservation (DEC) publishes fire danger ratings for each Fire Danger Rating Area (FDRA) in the State. The use of sparkling devices at any location within a FDRA designated by the DEC as having a fire danger rating of extreme (red) at any time when such designation is in effect is prohibited.

When can I buy Sparkling Devices?

Certified retailers can sell devices from Jun 1 to July 5 and again from Dec 26 to Jan 1. Tent retailers are limited to June 20 to July 5 and Dec 26 to Jan 1. As of the date of this document, the following counties have notified the Office of Fire Prevention and Control that the sale and use of Sparkling Devices is prohibited: Bronx, Columbia, Kings, Nassau, New York, Queens, Richmond, Schenectady, Suffolk, and Westchester. As always, in dry weather conditions or during a burn ban these devices should not be used.

Where can I use Sparkling Devices?

Sparkling Devices are intended for outdoor use only. They should not be within 10 feet of a building or structure. Local ordinance may also limit the quantity of devices that can be stored in a residence for personal use.

Are Sparkling Devices safe to use?

Any device that uses flammable chemicals is a risk. Sparkling devices can produce temperatures of approximately 2000 degrees Fahrenheit. This can cause serious burns and fire risk. These items should not be handled by children. Never place these devices on your body or pass a lit item to another person. Follow all package directions. What do I do with the Sparkling Devices after they have been used?

All burned devices should be soaked with water and only put into the trash after it is assured that they are cooled. Any items that did not activate should never be reignited and should be soaked as well before disposal.
